What are the sanctions for non-compliance with the provisions of the Loi Macron law?
The Republic of France imposes very severe penalties on owners of foreign transport companies. Failure to comply with the law laid down in the Loi Macron – threatens penalties not only in the case of intentional infringement, but also when the driver does not have the required certificates and documents with him.
No posting certificate or if the certificate is incorrect,
incomplete or illegible – fine up to €750
No required documents,
other than a certificate – fine of up to € 450
Attention: The amount of the fine may not exceed:
- 2000€ – for each posted worker
- 4000€ – In the event of a re-infringement within one year of notification of the imposition of the penalty
- 500000€ – total amount per enterprise
In determining the amount of the fine, the administration shall take into among others the circumstances and infringement of the law.
LOI MACRON:
The Loi Macron law is Decree No. 2016-418, which entered into force on 1 July 2016, determines, among other things, the minimum salary sent to the French Republic for drivers employed in other countries.
These rules apply to cabotage and bilateral transport. They do not apply only to transit operations. Loi Macron imposes a number of new obligations on businesses. One of the main objectives is to appoint a representative who will be the link between the carrier and the French administration.
